Alpha Contracting & Sons alleged to have failed to replace generator

FAYETTEVILLE – A Fayetteville woman alleges that a Beckley business installed a generator that does not sufficiently power her house.

Charlotte Ann Harless filed a complaint Sept. 28 in Fayette Circuit Court against Alpha Contracting & Sons Inc. and Travis Hicks alleging breach of contract and other counts.

According to the complaint, the plaintiff contracted the defendants to provide and install and generator and transfer switch. The suit states that the generator was guaranteed to power all circuits in the plaintiff's house, including the electric furnaces and range. She alleges the generator does not perform as guaranteed and that the defendants have refused to replace the generator.

The plaintiff holds Alpha Contracting & Sons Inc. and Hicks responsible because the defendants allegedly breached the guarantee that Alpha Contracting would replace the generator with a larger one if the first failed.

The plaintiff requests a trial by jury and seeks legal damages, consequential and incidental damages, order the defendants to provide and install a larger generator, court costs and any further relief the court grants. She is represented by Kyle G. Lusk, Matthew A. Bradford and Brandon L. Gray of Lusk & Bradford PLLC in Beckley. The case has been assigned to Circuit Judge Paul M. Blake Jr.
