Woman alleges Express Employment Professionals terminated her after notification of pregnancy

CHARLESTON – A woman alleges that her former employer discriminated against her because of her sex.

Michelle Toliver filed a complaint Oct. 2 in Kanawha Circuit Court against Thomas Andrew Wirts Enterprises LLC, doing business as Express Employment Professionals, alleging violation of the West Virginia Human Rights Act.

According to the complaint, the plaintiff began working for the defendant in July 2017. The suit states that on Aug. 9, 2017, she was terminated from her employment just one day after informing defendant that she was pregnant. 

The plaintiff seeks compensatory and punitive damages, costs of litigation, pre- and post-judgment interest and such other legal relief deemed appropriate. She is represented by Robert B. Warner and Philip Estep of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
