CHARLESTON – A Red House man alleges he was injured while working on the Ohio River when his hands were crushed.
Joshua P. Legg filed a complaint Oct. 2 in U.S. District Court for the Southern District of West Virginia against Amherst Madison Inc. alleging negligence, breach of warranty of seaworthiness and other counts.
According to the complaint, the plaintiff alleges that on Oct. 7, 2015, while he was in the course and scope of his employment with the defendant on the Ohio River, his hand was crushed between a log he was trying to remove and the barges. He alleges he suffered severe and permanent injuries to his hands, including partial imputation of his right index finger and a deep laceration on his left palm.
The plaintiff holds Amherst Madison Inc. responsible because the defendant allegedly failed to provide sufficient personnel and proper tools to dislodge floating debris.
The plaintiff requests a trial by jury and seeks general, special and punitive damages, pre- and post- judgment interest, attorney's fees, cost and such other just and proper relief. He is represented by Scott S. Segal and Jason P. Foster of The Segal Law Firm in Charleston.
