Taco Bell customer seeks damages after fall allegedly caused by leaking soda machine

CHARLESTON – A Dunbar woman alleges she fell at a St. Albans restaurant because of water on the floor.

Charlotte Fleshman filed a complaint Oct. 4 in Kanawha Circuit Court against Taco Bell of America LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 23, she was injured when she slipped and fell inside defendant's Taco Bell restaurant because of a water leak from the fountain drink machine. She alleges she sustained injuries to her back, left wrist and pelvic area that required long-term medical treatment. 

The plaintiff holds Taco Bell of America LLC responsible because the defendant allegedly negligently allowed water leak to accumulate on the floor and cause a slip hazard.

The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court, attorney fees, costs and such other just and proper relief. She is represented by Michael M. Cary of Cary Law Office PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
