CHARLESTON – A Charleston auto dealer is alleged to have sold a defective vehicle without disclosing the defects to a consumer.
Loretta Martin filed a complaint Oct. 4 in Kanawha Circuit Court against Moses Cadillac Buick GMC Truck Inc. alleging unlawful sales practices in violation of the state's consumer protection statues.
According to the complaint, the plaintiff alleges that in September 2016, she purchased a 2014 GMC Yukon XL from the defendant. She alleges she later took the vehicle to a body shop in March to repair mechanical problems and was informed that the vehicle had been repainted and had prior damages that had been repaired. She alleges this was not disclosed to her when she purchased the vehicle.
The plaintiff requests a trial by jury and seeks compensatory damages in an amount that exceeds the jurisdictional limits of this court, plus court costs and any further relief this court grants. She is represented by Michael M. Cary of Cary Law Office PLLC in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
