CHARLESTON – The owners of an Elkview property allege that former tenants abandoned it without paying past-due rent and taxes.
Newport II LLC filed a complaint Oct. 4 in Kanawha Circuit Court against Slurp & Surf LLC, doing business as Tanfastiq, Nichole Holbert and Matthew Holbert alleging breach of contract.
According to the complaint, the plaintiff and defendants entered into a five-year, triple net lease agreement for the plaintiff's premises in Credes Corner in Elkview. The suit states the defendants notified the plaintiff on Sept. 6 that they did not intend to renew the lease.
The plaintiff alleges that the defendants owed past-due rent and taxes of $8,070 and that they have failed to cure the default.
The plaintiff requests a trial by jury and seeks judgment against the defendant for amounts due and owing under the lease, court costs, interest and any further relief the court grants. It is represented by Elizabeth G. Kavitz of Kavitz Law PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
