Save-A-Lot customer alleges he needed surgery after falling at Moundsville store

MOUNDSVILLE – A Proctor man alleges he was injured at a Moundsville store because of a fall caused by liquid on the floor.

Darrick Williams filed a complaint Oct. 6 in Marshall Circuit Court against E&M Investments Inc., doing business as Save-A-Lot of Buckhannon; Edmark Inc.; and Everett Bisner alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 7, 2015, he was a lawful guest at defendants' Save-A-Lot in Moundsville when he slipped on a red liquid on the floor. He alleges as a result of the fall, he sustained serious and permanent injuries that required anterior cervical discectomy and fusion surgery. 

The plaintiff holds E&M Investments Inc., Edmark Inc. and Bisner responsible because the defendants allegedly failed to comply with the statutory safety standards and failed to warn the general public of the existence of such condition.

The plaintiff requests a trial by jury and seeks compensatory damages, pre- and post-judgment interest, costs and such other relief as the court may find necessary. He is represented by Don A. Yannerella of Yannerella Law Offices in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
