PRINCETON – The administrator of a late McDowell County woman's estate has filed a suit over the woman's death against a medical facility and physician.
Janet Graham, administratrix of the estate of Edna Marie McNeely, filed a complaint Oct. 6 in Mercer Circuit Court against Sunil Kumar Dhar MD, Bluefield Clinic Co. LLC, et al. alleging medical malpractice.
According to the complaint, McNeely presented to the Bluefield Regional Medical Center's emergency department on March 10, 2016, with complaints of chest pain. The suit states she was treated by Dhar, who performed a diagnostic cardiac catheterization and percutaneous advanced intervention. The suit states McNeely's post-operative deterioration worsened March 11, 2016, and she was transferred to another facility the following day.
The plaintiff alleges that as a result of septic shock due to retroperitoneal bleed suffered by McNeely, she died on March 13, 2016.
The plaintiff holds Dhar, Bluefield Clinic Co. LLC, et al. responsible because the defendants allegedly failed to properly administer a transfusion of packed red blood cells in a timely manner, failed to timely order CT scans and failed to monitor decedent's condition throughout her hospitalization.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre- and post-judgment interest and all other relief that are just under the circumstances. She is represented by Robert B. Warner, Lynnette Simon Marshall and Andrew D. Byrd of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Derek C. Swope.
