BECKLEY – A Raleigh County business alleges a Mercer County business failed to pay for six vehicles it purchased.
Beckley Buick-GMC Auto Mall Inc. filed a complaint Oct. 6 in Raleigh Circuit Court against East Coast Auto Sales Inc. alleging breach of contract, conversion and fraud.
According to the complaint, the plaintiff alleges that between June and August 2017, plaintiff provided six motor vehicles to defendant on credit.
The plaintiff holds East Coast Auto Sales Inc. responsible because after remitting payment via check and taking possession of the vehicles, the defendant allegedly paced a stop-payment order on the subject checks and wrongfully retained possession of the subject vehicles.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, legal interest, attorney's fees, costs and such other special and general relief. It is represented by Geoffrey Cullop of Pullin, Fowler, Flanagan, Brown & Poe PLLC in Charleston. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
