Former Home Depot manager alleges discrimination led him to resign

HUNTINGTON – A Lesage man alleges he had to quit his job because of racial and religious discrimination from a supervisor.

Najib Ayoub filed a complaint Oct. 10 in Cabell Circuit Court against Home Depot U.S.A. Inc. and James F. Samuel alleging constructive discharge and discrimination in contravention of the West Virginia Human Rights Act.

According to the complaint, the plaintiff was hired as an assistant store manager at Home Depot in July 2015 and received all positive performance reviews and awards. The suit states that in October 2016, Samuel became the store manager. The plaintiff alleges Samuel harassed him, screamed at him and called him racist names. 

The suit states the plaintiff took a medical leave of absence because because of stress relating to the job, then resigned in July after he found a new job with a $34,000 per year pay cut.

The plaintiff holds Home Depot U.S.A. Inc. and Samuel responsible because the defendants allegedly subjected him to a hostile work environment.

The plaintiff seeks judgment against the defendants for compensatory, consequential and punitive damages, other damages, court costs and any further relief the court grants. He is represented by James D. McQueen Jr. and Lisa A. Billings of McQueen Davis PLLC in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
