Resurrection Coal Co. Inc. alleged to owe REI Drilling more than $80,000 for drilling

BLUEFIELD – A McDowell County coal company is alleged to have failed to pay a Salt Lake City company in full for its services.

REI Drilling Inc. filed a complaint Oct. 16 in U.S. District Court for the Southern District of West Virginia against Resurrection Coal Co. Inc. alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff performed drilling and related services for the defendant its Bartley coal mine in October 2012.

The plaintiff holds Resurrection Coal Co. Inc. responsible because the defendant allegedly failed to pay in full all invoices sent by the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $83,756.34 plus interest, or an amount not less than $83,756.34 plus interest, court costs and any further relief the court grants. It is represented by J. Mark Adkins and Andrew C. Robey of Bowles Rice LLP in Charleston.
