Property owners allege Columbia Gas pipeline has caused landslides

WAYNE – A Kenova couple alleges that the installation of a pipeline above their property has caused landslides and property damage.

Roger Napier and Marsha Napier filed a complaint Oct. 16 in Wayne Circuit Court against Columbia Gas Transmission LLC alleging negligence.

According to the complaint, the defendant constructed a pipeline on the ridge line property above the plaintiffs' residence. The plaintiffs allege that since the pipeline was installed, their property has been damaged by continuous and ongoing landslides, surface slippage and adverse water flow. The plaintiffs allege they have expended thousands of dollars in an attempt to mitigate the flow of water and have suffered loss of value of their property, interference with habitability, annoyance and inconvenience. 

The plaintiffs hold Columbia Gas Transmission LLC responsible because the defendant allegedly failed to keep the pipeline in a proper state of repair failed and compensate them for their damages.

The plaintiffs request a trial by jury and seek judgment against defendant in an amount that will fully compensate them for their damages, pre- and post-judgment interest, costs of court and such other relief deemed reasonable. They are represented by Kenneth P. Hicks of Kenneth P. Hicks LC in Huntington. The case has been assigned to Circuit Judge Darrell Pratt.
