Physician, Reynolds Memorial Hospital named in suit after woman dies of cardiac issue

MOUNDSVILLE – A mother has filed suit against a Glen Dale medical facility failed to inform her later daughter of her life-threatening cardiac condition.

Kathryn M. Whipkey, administratrix of the estate of Rebecca M. Whitlatch, filed a complaint Oct. 19 in Marshall Circuit Court against William A. Martin, DO and Reynolds Memorial Hospital Inc. alleging breach of standard of care.

According to the complaint, the plaintiff alleges that on June 26, 2016, Whitlatch went to the emergency room of Reynolds Memorial for high blood pressure. The suit states Martin evaluated her, prescribed her a medication and ordered tests and advised her to follow up with her physician.

The suit states Whitlatch went to the defendant's emergency room again on Oct. 20, 2016, with chest pain complaints. The suit states Whitlatch left the facility without being advised she was having an active myocardial infarction and she later died that day.

The plaintiff holds Martin and Reynolds Memorial Hospital Inc. responsible because the defendants allegedly failed to provide Whitlatch the applicable standard of medical care required by her circumstances.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, in such amounts that will fully compensate them for their damages, pre- and post-judgment interest, attorney's fees and costs of this action. She is represented by Timothy R. Linkous of Linkous Law PLLC in Morgantown and J. Michael Benninger of Benninger Law PLLC in Morgantown. The case has been assigned to Circuit Judge David W. Hummel Jr.
