Erie Insurance accused of wrongfully denying coverage for dwelling fire

LOGAN – The owners of a Bruno property allege their insurer wrongfully denied coverage for damages from a fire.

Woodrow Gillispie and Vicki Gillispie filed a complaint Oct. 20 in Logan Circuit Court against Erie Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs own a property in Bruno and purchased insurance coverage through Erie. The suit states the dwelling was destroyed by fire on Aug. 26.

The plaintiffs hold Erie Insurance Co. responsible because the defendant allegedly refused to indemnify the plaintiffs, which they allege is a breach of the insurance policy.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount that exceeds the jurisdictional limits of the court, court costs, punitive damages, interest and any further relief this court grants. They are represented by Jeffrey S. Simpkins of Simpkins Law in Williamson. The case has been assigned to Circuit Judge Eric H. O'Briant.
