NEW MARTINSVILLE – A New Martinsville resident alleges he was induced to purchase a property based on material and false representations.
Dominic D. Yost filed a complaint Oct. 26 in Wetzel Circuit Court against The Bank of New York Mellon, also known as BNY Mellon c/o CT Corporation System, et al. alleging fraud and other counts.
According to the complaint, the defendants offered for sale a property on Foundry Street that was advertised as two parcels. The suit states the plaintiff closed on the property in July 2015. The plaintiff alleges he discovered in February 2016 that he was sold only one parcel of the property instead of both. He alleges that defendants did not have the titles to both parcels to sell.
The plaintiff holds the defendants responsible because the defendants allegedly provided false information to the plaintiff regarding the real property they were selling.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of this court, punitive damages, court costs and any further relief this court grants. He is represented by David A. Jividen of Jividen Law Offices PLLC in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
