HUNTINGTON – A man has filed a suit against his employer over an amount being withheld from his paycheck to cover medical insurance for his children.
Christopher Lee O'Brien filed a complaint Oct. 27 in Cabell Circuit Court against Results Customer Solutions LLC alleging negligence.
According to the complaint, the plaintiff has been employed by the defendant since April and in September, the defendant began withholding $98 per pay period from the plaintiff's check. The suit states this amount was withheld per a National Medical Support Notice issued by the state's Department of Health and Human Resources, Bureau of Child Support Enforcement stemming from a court order.
The plaintiff alleges that he informed the defendant that the amount withheld is limited to 5 percent of his income, but the defendant has failed to disclose the children's medical insurance premium portion. He alleges the amount withheld is greater than 5 percent.
The plaintiff holds Results Customer Solutions LLC responsible because the defendant allegedly wrongfully withheld the health insurance premium and wrongfully withheld from his salary.
The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court, with interest, costs and such other just and proper relief. He is represented by J. Williams St. Clair of Legal Aid of West Virginia in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
