Woman alleges injuries in collision with Logan County Board of Ed vehicle

LOGAN – A Baisden woman is seeking damages after an auto collision with a Logan County Board of Education vehicle.

Linda Hatfield filed a complaint Nov. 21 in Logan Circuit Court against the defendants alleging Logan County Board of Education, Gary McComis Jr. and Grace Kaylee Bannister alleging negligence.

According to the complaint, on Oct. 28, 2015, the plaintiff was a passenger in a vehicle operated by her husband traveling northbound on Route 52. The suit states Bannister, who was driving a vehicle owned by the Logan County Board of Education and under the supervision of McComis, collided with the plaintiff's vehicle at an intersection.

The plaintiff holds Logan County Board of Education, McComis Jr. and Bannister responsible because the defendants McComis and Bannister allegedly failed to maintain proper control of the vehicle, failed to maintain careful lookout and failed to yield to the right of way.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, for all damages, interest, attorney's fees, costs and expenses and such other relief to which she is entitled. She is represented by Brian L. Ooten of Shaffer & Shaffer PLLC in Madison. The case has been assigned to Circuit Judge Eric H. O'Briant.
