Individuals seek to declare Wetzel County well abandoned

NEW MARTINSVILLE – Three individuals residing out-of-state who own interests in oil and gas in Wetzel County are seeking to declare that a well has been abandoned.

David M. Eddy, Barbara A. Eddy, and Debra K. Eddy filed a complaint Nov. 3 in Wetzel Circuit Court against EQT Production Co. seeking declaratory relief.

According to the complaint, the plaintiffs allege that Well 705 on the property has not produced gas since January 2009 and the state's Department of Environmental Protection classifies it as an abandoned well. The suit states that EQT is a successor in interest to the well.

The plaintiffs request a trial by jury and seek declare that the Well 705 is abandoned, declare that the oil and gas lease concerning the subject oil and gas are no longer in force and effect, declare that the oil and gas underlying the subject property is no longer held by production and any further relief this court grants. They are represented by Philip J. Bowser of Snyder & Hassig in New Martinsville. The case has been assigned to Circuit Judge David W. Hummel Jr.
