HUNTINGTON – A Lawrence County, Ohio woman alleges she was terminated from her position as a restaurant assistant manager after she had to leave work to attend a court hearing.
Sheila A. Williams filed a complaint Nov. 6 in Cabell Circuit Court against Bob Evans Farms LLC alleging wrongful termination.
According to the complaint, the plaintiff began employment with the defendant on Dec. 1, 2010, at its Kinetic Park, Huntington restaurant. The suit states she was required to attend a court hearing on March 22 and notified the defendant, but she was terminated that day when she returned from court.
The plaintiff holds Bob Evans Farms LLC responsible because the defendant allegedly knew that the plaintiff was ordered to testify in court and was even offered by the plaintiff the documentation from the Lawrence County Probate Juvenile Court, but still terminated her employment for missing work.
The plaintiff seeks judgment against the defendant for damages, lost wages, lost profits, punitive damages and any further relief this court grants. She is represented by Walt Auvil of The Employment Law Center PLLC in Parkersburg. The case has been assigned to Circuit Judge Alfred E. Ferguson.
