Auction company allegedly failed to remit money after property sale

KINGWOOD – A Shinnston company is alleged to have failed to pay an individual money owed to her after the sale of a property.

Sandra Pride filed a complaint Nov. 6 in Preston Circuit Court against Joe R. Pyle Complete Auction and Realty Limited Liability Co. alleging fraud.

According to the complaint, the plaintiff and defendant entered into agreements this year regarding the sale of a property in Masontown. The suit states the defendant was to remit any remaining balance of the sale to the plaintiff. The plaintiff alleges the property was auctioned May 30.

The plaintiff holds Joe R. Pyle Complete Auction and Realty Limited Liability Co. responsible because the defendant allegedly refused to account for and pay the plaintiff for amounts due to her for the earnest money deposit.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that will adequately compensate the plaintiff, punitive damages, court costs, interest and any further relief the court grants. She is represented by Gregory W. Sproles of Gregory W. Sproles, PLLC in Summersville.
