Driver alleges RD Expedited tractor-trailer went left of center, struck vehicle on Route 250

NEW MARTINSVILLE – A driver is seeking damages after a collision with a tractor-trailer near Hundred.

Marty Moyers filed a complaint Nov. 2 in Wetzel Circuit Court against RD Expedited Inc. and Mohammad Naqib alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 8, 2015, he was injured when the pickup truck he was driving was struck by a tractor-trailer being operated by defendant Naqib, who traveled left of the center line on Route 250. The suit states Naqib was acting in the course and scope of his employment with defendant RD. He alleges he sustained injuries that caused him to suffer pain and suffering, mental anguish, non-economic damages and incurred medical expenses. 

The plaintiff holds RD Expedited Inc. and Mohammad Naqib responsible because defendant Naqib allegedly failed to operate the vehicle in a safe and prudent manner and wrongfully traveled of center in a curve.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, costs and expenses for this action and such other just and proper relief. He is represented by Dino Colombo and Jon R. Godwin of Colombo Law in Morgantown. The case has been assigned to Circuit Judge David W. Hummel Jr.
