Patient files suit against Scott Orthopedic Center over treatment of ankle injury

HUNTINGTON – A Kermit man alleges that his ankle fracture was not properly treated by a Huntington physician.

Erick Charles filed a complaint Nov. 3 in Cabell Circuit Court against Kevin Brown DPM and Scott Orthopedic Center Inc. alleging negligence.

According to the complaint, the plaintiff fractured his right ankle in an auto accident on June 10, 2015, and was taken to the emergency department at St. Mary's Medical Center. The suit states Brown performed surgery on the plaintiff's ankle the next day and another procedure on June 20, 2015. The plaintiff later had a below the knee amputation on July 5, 2016, the suit states.

The plaintiff holds Kevin Brown DPM and Scott Orthopedic Center Inc. responsible because the defendants allegedly negligently deviated from the from the accepted standard of care by failing to correctly manage the ankle fracture and by failing to provide appropriate wound management.

The plaintiff requests a trial by jury and seeks all damages, with interest, costs of court and such other appropriate relief. He is represented by Ben Salango of Preston & Salango PLLC in Charleston and Joshua S. Ferrell and Nathan D. Brown of Ferrell & Brown PLLC in Williamson. The case has been assigned to Circuit Judge Christopher D. Chiles.
