Diskriter alleges financial damages after breach with Aletco Healthcare Services

WHEELING – A Pennsylvania corporation alleges it was damaged when a medical transcription services agreement was breached by Ohio County companies.

Diskriter Inc. filed a complaint Nov. 3 in Ohio Circuit Court against Aletco Healthcare Services Ohio Valley LLC, Peggy Coster, et al. seeking preliminary and permanent injunction.

According to the complaint, the plaintiff alleges that in January 2011, defendants made plaintiff as the exclusive vendor of their transcription services to Ohio Valley Health Services and Education Corp. The suit states that Ohio Valley Health Services and Education Corp. later breached the agreement by not using the plaintiff as the exclusive vendor for transcription services and ceased using the plaintiff as of Nov. 1.

As a result of defendants' conduct, the plaintiff alleges it has suffered immediate and irreparable damages for business interruption resulting in significant loss of revenue of approximately $60,000 per month. 

The plaintiff seeks temporary and permanent injunction enjoining defendants from utilizing transcription services of any other parties during the term of the agreement, award for costs and expenses for this action and all other relief that is just and equitable. It is represented by Jeffrey A. Grove and David L. Delk Jr. of Grove, Holmstrand & Delk PLLC in Wheeling. The case has been assigned to Circuit Judge Jason A. Cuomo.
