Mechanic claims Chaney's Auto Repair & Towing unlawfully took deducations from paycheck for car damage

NEW CUMBERLAND – A mechanic for a Chester business alleges that deductions were unlawfully made from his paycheck.

Jason Seevers filed a complaint Nov. 14 in Hancock Circuit Court against Chaney's Auto Repair & Towing LLC, in care of Michael W. Geibel Sr., citing the West Virginia Payment and Collection Act.

According to the complaint, in October 2014 the plaintiff was employed by the defendant and was changing the oil in a Kia Optima when he was called to meeting by a supervisor before he could complete the job. He alleges that during this meeting, another employee took the Kia for a test drive, causing engine damage amounting to $3,243.93. He alleges the defendant began deducting $50 per pay in October 2014 to make him financially responsible for the damage to the Kia and continued to do so until February 2016. 

The plaintiff holds Chaney's Auto Repair & Towing LLC responsible because the defendant allegedly made deductions to the plaintiff's paycheck without a valid order and without a written authorization from him.

The plaintiff requests a trial by jury and seeks judgment against the defendant for lost wages, interest, court costs and any further relief the court grants. He is represented by Frank X. Duff and Sandra K. Law of Schrader Byrd & Companion PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
