Mardi Gras Casino guest seeks more than $75,000 for injuries caused by chair collapse

CHARLESTON – A Mingo County woman alleges she was injured at a casino after a chair collapsed.

Brenda Layne filed a complaint Nov. 8 in Kanawha Circuit Court against Racing Corp. of West Virginia, doing business as Mardi Gras Casino & Resort, alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 25, 2015, she was injured at defendant's premises when one of the chairs collapsed and an unknown patron struck and knocked the plaintiff down. She alleges as a result, she sustained injuries resulting in pain and suffering, medical expenses, diminished ability to enjoy life and physical impairment. 

The plaintiff holds Racing Corp. of West Virginia responsible because the defendants allegedly failed to maintain the premises in a reasonably safe condition.

The plaintiff requests a trial by jury and seeks damages of more than $75,000, costs, attorney's fees, pre- and post-judgment interest and such other proper relief. She is represented by Greg K. Smith and Zachary H. Staten of the Law Offices of Greg K. Smith in Williamson.
