Mountaineer Casino guest alleges employee's actions caused him to fall

NEW CUMBERLAND – A man alleges he was injured at a Hancock County casino because of the negligence of an employee.

Joseph P. Farrelly Jr. filed a complaint Nov. 13 in Hancock Circuit Court against Mountaineer Park Inc., doing business as Mountaineer Casino Racetrack & Resort, alleging negligence.

According to the complaint, the plaintiff alleges that sometime in March or April 2017, he was standing outside defendant's hotel entrance/exit door near the valet stand. The suit states an employee abruptly opened the door, causing the valet stand cubicle to collide with a female patron, who then collided with plaintiff and caused him to fall. He alleges he sustained injuries to his left ankle that resulted in pain and suffering, mental anguish and lost wages and loss of enjoyment of life. 

The plaintiff holds Mountaineer Park Inc. responsible because the defendant alleged failed to exercise ordinary care in the operation and training of the valets.

The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court with interest, costs and such other just and proper relief. He is represented by Donald J. Tennant Jr. of Tennant Law Offices in Wheeling. The case has been assigned to Circuit Judge Jason A. Cuomo.
