Central Appalachia Empowerment Zone of West Virginia alleges it is owed more than $19,000

FAYETTEVILLE – A nonprofit alleges that it is still owed for services it provided to a Kincaid nonprofit.

Central Appalachia Empowerment Zone of West Virginia Corp. filed a complaint Nov. 13 in Fayette Circuit Court against Southern Appalachian Labor School Foundation Inc. alleging breach of agreement.

According to the complaint, the plaintiff alleges that between Jan. 1, 2015, and May 31, 2017, it provided certain services on behalf of defendant, including the management of the Regina Three Apartments for a total amount of $25,649.85. After applying all credits, the suit states the balance amount of $19,649.85 remains due and unpaid. 

The plaintiff holds Southern Appalachian Labor School Foundation Inc. responsible because the defendant allegedly failed and refused to make payments for the said amount.

The plaintiff requests a trial by jury and seeks payment in the sum of $19,649.85, pre- and post-judgment interest, attorney's fees, costs and expenses and such other relief as the court deems proper. It is represented by Gregory W. Sproles of Gregory W. Sproles PLLC in Summersville. The case has been assigned to Circuit Judge John W. Hatcher Jr.
