Patient alleges LabCorp failed to assist her after blood draw

CHARLESTON – A Charleston woman alleges she was injured when she lost consciousness after having her blood drawn.

Taylor Berry filed a complaint Nov. 9 in Kanawha Circuit Court against Laboratory Corp. of America Holdings alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 11, 2015, she was at defendant's clinical laboratory for a blood work. After the procedure, she alleges she felt nauseous and sick and was assured by defendant's staff that she would be fine. 

The suit states she took steps without assistance, lost consciousness while walking and fell to the floor face first. She alleges she sustained injuries to her lips, chin and nose. 

The plaintiff holds Laboratory Corp. of America Holdings responsible because the defendant allegedly failed to monitor and or assist the plaintiff after drawing blood.

The plaintiff requests a trial by jury and seeks damages in an amount to be determined at trial, pre- and post-judgment interest, costs, attorney's fees and such other and further relief. She is represented by Timothy C. Bailey and Taylor M. Norman of Bailey Javins & Carter LC in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
