FAYETTEVILLE – A certified nursing assistant alleges she was wrongfully discharged from her position and that her health information was unlawfully shared with other employees.
Amber D. Frye filed a complaint Nov. 9 in Fayette Circuit Court against Genesis Healthcare LLC and Christopher Marshall alleging that they violated the Health Insurance Portability and Accountability Act.
According to the complaint, the plaintiff began her employment with Genesis as a certified nursing assistant in November 2016. She alleges Marshall, also an employee of the defendant, disclosed her private health information to other employees. The suit states she was terminated March 10.
The plaintiff holds Genesis Healthcare LLC and Marshall responsible because the defendants allegedly negligently allowed her personal private health information to be disseminated to other employees and terminated her for inquiring about other employees' conduct.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages and such other relief as may be justified by evidence. She is represented by Anthony M. Salvatore of Hewitt & Salvatore in Fayetteville. The case has been assigned to Circuit Judge Paul M. Blake Jr.
