Man alleges he was laid off from job at Elk Creek mine after filing for workers' compensation

LOGAN – A Stollings man formerly employed to work at a coal mine in Elk Creek alleges he was laid off in retaliation after suffering an injury while working.

Oscar Craig Adkins filed a complaint Nov. 21 in Logan Circuit Court against Strata Mine Services LLC and Ramaco Resources LLC alleging violation of worker's compensation discriminatory practices.

According to the complaint, the plaintiff alleges that on Aug. 16, he injured his left middle finger which resulted in its partial amputation. He alleges when he was cleared to return to work, he contacted his supervisor on Sept. 21 and was laid off.

The plaintiff holds Strata Mine Services LLC and Ramaco Resources LLC responsible because the defendants allegedly violated law by retaliating against him for being injured on the job and filing for workers' compensation benefits.

The plaintiff requests a trial by jury and seeks damages, including lost wages and benefits; court costs; interest and any further relief the court grants. He is represented by Steven S. Wolfe of Wolfe, White & Associates in Logan. The case has been assigned to Circuit Judge Eric O'Briant.
