Widow files suit against physician, Beckley Vascular Associates over husband's death

BECKLEY – A Beckley widow is seeking damages after her husband died from complications from a surgery.

Melissa Dawn Barton, executrix of the estate of Fredric David Barton, filed a complaint Nov. 21 in Raleigh Circuit Court against Courtney Katril Pettiford, M.D. and Beckley Vascular Associates PLLC, doing business as River Region Surgical Specialists alleging negligence.

According to the complaint, the plaintiff alleges that in Oct. 7, 2015, Pettiford performed a hernia procedure on Fredric David Barton. The suit states he died Oct. 10, 2015, because of sepsis and multi-system organ failure caused by a bowel injury sustained during the hernia surgery.

The plaintiff holds Pettiford and Beckley Vascular Associates, PLLC responsible because the defendants allegedly breached the standard of care.

The plaintiff requests a trial by jury and seeks compensatory damages, interest and any further relief the court grants. She is represented by R. Dean Hartley and Mark R. Staun of Hartley Law Group PLLC in Wheeling and Anthony J. Sparacino Jr. of Sparacino Law Office in Beckley. The case has been assigned to Circuit Judge John A. Hutchison.
