HUNTINGTON – A Cabell County couple claims that their property was damaged after the installation of two heat pumps.
Gilberto Garza and Maria Garza filed a complaint Nov. 17 in Cabell Circuit Court against CADCO Heating and Cooling Inc. and its president Chris Staten alleging breach of contract.
According to the complaint, the plaintiffs allege that on Jan. 2, 2014, the parties entered into a contract in which defendants would provide all equipment, tools and labor to install two geothermal Trane two-stage heat pumps at plaintiffs' home. The plaintiffs allege the defendants' workmanship was substandard and damaged their property.
The plaintiffs hold CADCO Heating and Cooling Inc. and Staten responsible because the defendants allegedly failed to perform the contractual work in a workmanlike manner.
The plaintiffs seek judgment against defendants, jointly and severally, for damages in an amount to be determined by jury, along with attorney's fees, costs and interest. They are represented by Dwight J. Staples and Gail Henderson-Staples of Henderson, Henderson & Staples LC in Huntington. The case has been assigned to Circuit Judge Gregory L. Howard Jr.
