CHARLESTON – A retired Lincoln County Marine Corps veteran alleges he was not notified of the pending cancellation of his life insurance policy.
Bill Walls filed a complaint Nov. 17 in U.S. District Court for the Southern District of West Virginia, Charleston Division against Military Officers Association of America, ReliaStar Insurance Co., et al. citing breach of contract, negligent cancellation of insurance policy and other counts.
According to the complaint, the plaintiff has a group term life insurance policy under MOAA and also had MediPlus health insurance benefits from MOAA. He alleges in 2010, he notified MOAA of his address change due to the 911 rural route reclassification. He alleges in July 2017, he was informed that his life insurance policy was canceled for nonpayment. He was later informed that his premium notices had been returned as undelivered when his address was changed due to the 911 rural route reclassification, the suit states.
The plaintiff holds Military Officers Association of America, ReliaStar Insurance Co., et al. responsible because the defendants allegedly failed to contact him by phone or email to inform him that his premium was overdue and would be canceled and refused to reinstate his insurance policy.
The plaintiff requests a trial by jury an award for compensatory, punitive and consequential damages, attorney's fees, costs and any other proper and equitable relief. He is represented by James D. McQueen Jr. of McQueen Davis PLLC in Huntington.
