Man files suit againts Allstate over underinsured motorist coverage

HUNTINGTON – A Cabell County man is in a dispute with his insurer regarding the amount of damages he sustained in a motor vehicle collision with an underinsured driver.

Robert Wallace and Terri Wallace filed a complaint in Cabell Circuit Court against Allstate Property and Casualty Insurance Co. alleging personal injury.

According to the complaint, Robert Wallace alleges that on Dec. 15, 2015, he suffered injuries and damages that resulted from a vehicle accident caused by an underinsured motorist. The suit states a dispute has arisen between him and the defendant regarding the amount of damages he sustained and the amount he is entitled under the underinsured coverage of the insurance policy issued by defendant. 

The plaintiff requests a trial by jury and seeks judgment against defendant for the amount found to be due under the contract, with interest, costs and such other appropriate relief. He is represented by Donald R. Capper of Donald R. Capper Law Office in Proctorville, Ohio. The case has been assigned to Circuit Judge Christopher D. Chiles.
