Security guard alleges Murphy Elevator failed to maintain elevator that injured him

CHARLESTON – A Hurricane man employed as a security guard alleges he was injured by an elevator while working.

Richard N. Arthur filed a complaint in Kanawha Circuit Court against The Murphy Elevator Co. alleging violation of the Elevator Safety Act and negligence.

According to the complaint, the plaintiff alleges that on Dec. 14, 2015, he was working as a security guard at the West Virginia Veterans Home in Barboursville, which the defendant operated under a maintenance contract for services on the elevators in the building. The suit states that when the plaintiff attempted to enter an elevator, the doors closed prematurely and struck the plaintiff. He alleges he injured his back, left hand and left foot.

The plaintiff holds The Murphy Elevator Co. responsible because the defendant allegedly failed to maintain the elevator in a safe condition.

The plaintiff requests a trial by jury and seeks medical expenses, lost wages and lost earnings, court costs, punitive damages, interest and any further relief the court grants. He is represented by Brian L. Ooten of Shaffer & Shaffer in Madison. The case has been assigned to Circuit Judge James C. Stucky.
