Carman claims CSX Transportation failed to provide safe place to work

HUNTINGTON – A carman alleges he was injured at a bridge yard because his railroad company employer failed to provide a safe place to work.

Eddie Jay Workman II filed a complaint on Dec. 5, 2017, in the Cabell Circuit Court against CSX Transportation Inc. alleging negligence.

According to the complaint, the plaintiff was employed by the defendant as a carman. The suit states on Dec. 8, 2014, he was in the course and scope of his employment with defendant and injured his foot when a 200-pound metal walkway bracket fell on it at the Barboursville bridge yard.

The plaintiff holds CSX Transportation Inc. responsible because the defendant allegedly failed to provide adequate supervision and failed maintain the walking trackside areas in a reasonably safe condition.

The plaintiff requests a trial by jury and seeks compensatory damages in excess of the minimum jurisdiction of the court, with interest, costs and all other appropriate relief. He is represented by Willard J. Moody, Michael R. Davis and M. Quentin Emick Jr. of The Moody Law Firm Inc. in Portsmouth, Virginia. The case has been assigned to Circuit Judge Paul T. Farrell.
