PINEVILLE – An Oceana family is seeking damages from a Virginia meat and seafood distributor after its driver struck a minor child.
Kristopher Spence and Dena Spence, as guardians and next friend of K.P.S., a minor filed a complaint Dec. 5 in Wyoming Circuit Court against Quality Meats Inc. and Willard James Wade alleging negligence.
According to the complaint, the plaintiffs allege that on April 26, 2017, plaintiffs' minor child K.P.S. was playing in an alley in front of a residence in Kopperston when defendant Wade carelessly operated the van owned by defendant Quality Meats and struck K.P.S., causing severe and debilitating injuries.
The plaintiffs hold Quality Meats Inc. and Wade responsible because defendant Wade allegedly operated the van while under the influence of alcohol and drugs. The suit states Wade was arrested, arraigned and indicted by a grand jury on charges of driving under the influence causing serious bodily injury.
The plaintiffs request a trial by jury and seek compensatory and punitive damages, costs, attorney fees, pre- and post-judgment interest and all other relief to which they are entitled. They are represented by D. Blake Carter Jr., J. Ryan Stewart and Taylor M. Norman of Bailey Javins & Carter LC in Charleston. The case has been assigned to Circuit Judge Warren R. McGraw.
