Elder-Beerman shopper alleges piece of display rack caused foot injuries

HUNTINGTON – A customer alleges an operator of a department store failed to maintain a section in the store and allowed tripping hazards to exist.

Sabrina Mounts filed a complaint Dec. 7 in Cabell Circuit Court against Bon-Ton Department Stores Inc., doing business as Elder-Beerman, alleging breach of duty.

According to the complaint, the plaintiff alleges that on Dec. 12, 2015, she was injured while shopping in the children's clothing section at Elder-Beerman's store in the Barboursville Mall. She alleges she stepped onto a piece of metal that was lying on the floor that was part of a display rack, causing her to twist her right foot and almost fall. 

The Huntington Mall location of Elder-Beerman closed last year.

The plaintiff seeks compensatory damages with legal interest and such other just and reasonable relief. She is represented by Timothy P. Rosinsky of Rosinsky Law Office in Huntington. The case has been assigned to Circuit Judge Christopher D. Chiles.
