Panther Mart LLC alleges J. Graff and Associates failed to correct defective equipment

WILLIAMSON – A Williamson convenience store and gas station operator alleges it was provided defective equipment.

Panther Mart LLC filed a complaint in Mingo Circuit Court against J. Graff and Associates alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that as part of preparing for the opening of its store and gas station, plaintiff purchased certain fuel pumps and pin pads from defendant to allow its customers to make purchases via debit/credit card transactions. The plaintiff alleges that the products have never worked and attempts to repair the issues have also failed.

As a result of defendant's allegedly defective equipment, the plaintiff claims it has lost and continues to lose store and fuel sales.

The plaintiff holds J. Graff and Associates responsible because the defendant allegedly provided defective equipment and failed to correct it.

The plaintiff requests a trial by jury and seeks actual, compensatory and punitive damages, disgorgement of profits, prejudgment interest, attorney's fees, costs and such other legal and equitable relief. It is represented by Nathan D. Brown and Joshua S. Ferrell of Ferrell & Brown PLLC in Williamson. The case has been assigned to Circuit Judge Miki Thompson.
