Couple claims Lincoln MKT doesn't conform to warranties

BECKLEY – A Beckley couple is seeking a refund of a Ford vehicle they purchased over allegations that it does not conform to its warranties.

Darlene Buchanan and David Buchanan filed a complaint in Raleigh Circuit Court against Ford Motor Co. citing West Virginia code.

According to the complaint, the plaintiffs purchased a new 2014 Lincoln MKT in April 2015 from an authorized retail dealer for more than $57,000. They allege that the vehicle has noncomformities with the new motor vehicle warranty and that such noncomformities may be life threatening.

The plaintiffs hold Ford Motor Co. responsible because the defendant allegedly failed to repair the defects found on the plaintiffs' vehicle despite having several opportunities to do so.

The plaintiffs request a trial by jury and seek revocation of acceptance and refund of the purchase price, damages for the costs of repairs and other incidental expenses, court costs and any further relief the court grants. They are represented by Stephen P. New of The Law Office of Stephen P. New in Beckley. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
