MOUNDSVILLE – A New Martinsville man is seeking damages from a Proctor chemical plant owner after a liquid chlorine leak forced him to evacuate his property in 2016.
Lawrence Bradley Cecil filed a complaint in Marshall Circuit Court against Axiall Corp. alleging negligence and other counts.
According to the complaint, the plaintiff alleges that in Aug. 27, 2016, a rail tanker at defendant's facility leaked a substantial amount of liquid chlorine that caused a chemical cloud to travel to the surrounding community. As a result, the plaintiff alleges he suffered personal injuries, his real and personal property were damaged and he was forced to evacuate his home to avoid exposure to toxic chemical.
The plaintiff holds Axiall Corp. responsible because the defendant allegedly failed to control, manage and/or contain the liquid chlorine in a safe manner and failed to take actions to limit the spreading of the chemical cloud.
The plaintiff requests a trial by jury and seeks compensatory, general and punitive damages, pre- and post-judgment interest, attorney's fees, costs and such other relief as the court deems proper. He is represented by James G. Bordas Jr. and Jeremy M. McGraw of Bordas & Bordas PLLC in Moundsville. The case has been assigned to Circuit Judge David W. Hummel Jr.
