Driver files suit against Joe Beard & Sons Corp. over collision on I-64

WINFIELD – A Scott Depot woman is seeking damages after a collision with a tractor-trailer on Interstate 64.

Linda Perez Smith filed a complaint in Putnam Circuit Court against Joe Beard & Sons Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 15, 2015, she was stopped on I-64 in Hurricane because of traffic congestion when her vehicle was struck by the defendant's tractor-trailer. She alleges she sustained severe and personal injuries and suffered physical pain, mental anguish and medical expenses. 

The plaintiff holds Joe Beard & Sons Corp. responsible because the defendant's employee/driver allegedly failed to maintain proper control of the tractor-trailer.

The plaintiff requests a trial by jury and seeks actual and compensatory damages, prejudgment interest, costs of court and such other relief to which she is entitled. She is represented by David M. Adkins of The Adkins Law Firm PLLC in Hurricane. The case was assigned to Circuit Judge Phillip M. Stowers.
