Summerville man alleges Raleigh General Hospital negligent discharged him after hernia surgery

BECKLEY – A Summersville couple has filed a negligence suit against Raleigh General Hospital and others over alleged injuries the husband sustained after a surgery.

Robert and Frankie Underwood filed a complaint on Dec. 26, 2017, in Raleigh Circuit Court against Raleigh General Hospital, Surgical Care of Southern WV, et al. alleging medical negligence.

According to the complaint, Robert Underwood underwent a laparoscopic hiatal hernia repair on April 10, 2017 at Raleigh General Hospital. The suit states on April 13, 2017, he went to the Raleigh General Hospital emergency room for extreme pain and was found to have suffered small bowel necrosis and gastric necrosis. He needed further procedures, the suit states.

The plaintiffs holds Raleigh General Hospital, Surgical Care of Southern WV, et al. responsible because the defendants allegedly negligently discharged him despite exhibiting no bowel movement and failed to provide medical care and treatment despite the plaintiff experiencing abdominal pain, constipation and dry heaving after undergoing robotic assisted hiatal hernia repair.

The plaintiffs request a trial by jury and seek compensatory and punitive damages, pre- and post-judgment interest, attorney's fees, costs and expenses and such other and further relief. They are represented by Ray W. Toney and Richard D. Lindsay of Tabor Lindsay & Associates in Charleston. The case has been assigned to Circuit Judge Andrew Dimlich.
