BECKLEY – A Raleigh County alleges she was terminated in retaliation and because of her age by a nursing facility.
Gwendolyn Lively filed a complaint in Raleigh Circuit Court against Stonerise Healthcare LLC, Riparian Investments LLC, et al. alleging that they violated the Patient Safety Act and other counts.
According to the complaint, the plaintiff was hired by Heartland of Beckley in May 2004, which was taken over by the defendants in October 2013. The suit states she was promoted to the position of dietary supervisor and terminated in December 2015 at the age of 55.
The plaintiff holds Stonerise Healthcare LLC, Riparian Investments LLC, et al. responsible because the defendants allegedly discriminated against her because of her age and terminated her employment in retaliation for refusing to perform tasks that would place residents' safety at risk and replaced her with a younger employee.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre- and post-judgment interest, attorney's fees, costs and such other just and equitable relief. She is represented by Michael A. Olivio and Stephanie H. Daly of Olivio Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Andrew Dimlich.
