Nurse claims Monongalia Health System terminated her because of vaccine allergy disability

CLARKSBURG — A registered nurse is suing Monongalia Health System, a healthcare provider, citing alleged disability discrimination and wrongful termination.

Georgette Chmura filed a complaint in U.S. District Court for the Northern District of West Virginia against Monongalia Health System alleging that the healthcare provider failed to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that, in Nov. 23, 2016, she was terminated form her employment for refusing to take influenza vaccine due to her severe influenza-vaccine allergy. She suffered actual damages. The plaintiff holds Monongalia Health System responsible because the defendant allegedly refused to provide reasonable accommodation by not allowing her not to take influenza vaccine and despite her attempt to engage in interactive process.

The plaintiff requests a trial by jury and seeks damages for loss wages, compensatory damages, legal fees, interest and all other just and proper relief. She is represented by David W.
