Man seeks to file copy of deed in Ohio County Clerk's Office

WHEELING – A Wheeling man is seeking declaratory relief regarding a deed that was lost in a fire.

Elias Edward Joseph filed a complaint in Ohio Circuit Court against Ohio County Clerk's Office seeking declaratory relief.

According to the complaint, the plaintiff is seeking an order permitting him to file a copy of a deed nunc pro tunc (or retroactively) in the Ohio County Clerk's Office. 

The suit states the plaintiff quitclaimed a deed to Betty Peralez in December 2013 that was properly notarized, sealed and signed by a notary public. Peralez did not record the deed in the Ohio County Clerk's Office and the residence was lost in a fire in March 2014. The plaintiff alleges the deed was lost in the fire.

The plaintiff requests that the court grant declaratory relief. He is represented by Don A. Yannerella in Wheeling.
