PRINCETON – A consumer claims a national bank invaded his privacy with collection calls.
Bill Finley filed a complaint Jan. 5 in Mercer Circuit Court against Atlanticus Holdings Corp., doing business as Fortiva Personal Loans alleging violation of the West Virginia Consumer Credit Protection Act and West Virginia Computer Crime and Abuse Act.
According to the complaint, the plaintiff received several phone calls from the defendant in an attempt to collect an alleged debt.
The plaintiff holds Atlanticus Holdings Corp. responsible because the defendant allegedly attempted to collect a debt by coercion, caused his phone to ring at unusual times or at times known to be inconvenient and invaded his privacy.
The plaintiff seeks actual damages, statutory damages, court costs, general compensatory damages, punitive damages, court costs and any further relief the court grants. He is represented by Ralph C. Young, Christopher B. Frost and Steven R. Broadwater Jr. of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville. The case has been assigned to Circuit Judge William J. Sadler.
