King Tire Service says Pritchard Mining owes more than $350,000

PRINCETON – A Bluefield company alleges a mining business failed to pay for goods it provided.

King Tire Service Inc. filed a complaint Jan. 2 in Mercer Circuit Court against Pritchard Mining Co. Inc. alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that in 2014, it sold tires and related merchandise for vehicles, heavy equipment and related services to defendant in the amount of $356,932.08. As of the filing of this complaint, the said amount allegedly remains unpaid. 

The plaintiff holds Pritchard Mining Co. Inc. responsible because the defendant allegedly failed to pay the items and services provided by plaintiff.

The plaintiff requests a trial by jury and seeks damages in the amount of $356,932.08, pre- and post-judgment interest, attorney's fees, costs and any other relief that are just and proper. It is represented by Arnold J. Janicker and Kierston Easthan Rosen of Jenkins Fenstermaker PLLC in Huntington. The case has been assigned to Circuit Judge Mark Wills.
