Woman alleges motorist fell asleep, caused Wheeling collision

WHEELING – A Wheeling woman alleges her vehicle was struck by another driver who had fallen asleep at the wheel.

Courtney D. Comack filed a complaint Jan. 2 in Ohio Circuit Court against Allstate Property and Casualty Insurance Co., Elisa Hickman and Jalonii Galloway alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 16, 2017, she was injured when her vehicle was struck by another vehicle driven by defendant Galloway and owned by defendant Hickman on Kruger Street in Wheeling. The plaintiff alleges she observed Galloway fall asleep behind the wheel before the collision.

The plaintiff alleges that Allstate removed her car after it was towed without authorization or permission.

The plaintiff holds Allstate Property and Casualty Insurance Co., Hickman and Galloway responsible because allegedly defendant Galloway allegedly drove while inattentive, Hickman negligently entrusted the vehicle to Galloway, and Allstate intentionally interfered with the plaintiff's property.

The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages, and all other legal and equitable relief. She is represented by Teresa C. Toriseva and Joshua D. Miller of Toriseva Law in Wheeling.
