Estate co-administrators of woman killed in Cherry Tree collision seek damages from driver, others

LOGAN – The co-administrators of an estate of a woman killed in a pedestrian/auto collision are seeking damages from the driver, the vehicle's owner and the establishment that allegedly sold the driver alcohol.

Stevina Workman and Sandra Nelson, as co-administratices of the estate of Clevina Ann Hackney, filed a complaint Jan. 3 in Logan Circuit Court against Todd Eric Deskins, Jenni's Front Room LLC and Chelsey Danyell Workman alleging negligence, wrongful death and other counts.

According to the complaint, on Sept. 5, 2017, Hackney sustained fatal injuries when she was struck by a Ford F-150 while walking on the shoulder on state Route 44 near Cherry Tree. The suit states the truck was driven by defendant Deskins and owned by defendant Workman and that Deskins left the scene. 

The suit states that Deskins was under the influence of alcohol that was sold to him by Jenni's Front Room.

The plaintiffs hold Deskins, Jenni's Front Room LLC and Workman responsible because defendant Workman allegedly negligently entrusted her vehicle to defendant Deskins when she knew that he was likely to negligently operate the said vehicle, because Deskins allegedly drove while under the influence, and Jenni's Front Room allegedly negligently sold nonintoxicating beer and liquor to Deskins when it knew or should have known he was intoxicated.

The plaintiffs request a trial by jury and seek judgment in excess of the jurisdictional limits of the court and such other relief deemed appropriate by the court. They are represented by Jeffrey S. Simpkins of Simpkins Law in Williamson. The case has been assigned to Circuit Judge Eric H. O'Briant.
